The appeal hearing against the verdict to abolish the caretaker government system has been set for October 21. The seven-member Appellate Division led by Chief Justice Syed Refat Ahmed passed the order after a review hearing today, Wednesday.
The order was given after granting leave (allowing the appeal) after hearing the petition seeking review of the verdict given to the Appellate Division 14 years ago to abolish the caretaker government system.
At the hearing, Attorney General Md. Asaduzzaman said that the Appellate Division can decide with leave or without leave if it wants.
At one stage, Chief Justice Syed Refat Ahmed said, “We will follow the tradition. We will hear the entire matter with leave. A permanent solution is needed regarding the caretaker government so that there is no crisis over it in the future.”
Barrister Ruhul Quddus Kajal, lawyers Sharif Bhuiyan, Ahsanul Karim and Mohammad Shishir Monir heard the review petition in the Appellate Division. Attorney General Md. Asaduzzaman was on the state side.
On May 10, 2011, the Appellate Division, headed by the then Chief Justice ABM Khairul Haque, declared the 13th Amendment to the Constitution regarding the caretaker government system null and void based on a majority opinion.
After the fall of the Awami League government, five prominent individuals including Badiul Alam Majumder, editor of Sushasang, filed a review petition for the Appellate Division’s ruling. Later, BNP Secretary General Mirza Fakhrul Islam Alamgir and Jamaat-e-Islami Secretary General Mia Golam Parwar filed a review petition. In addition, last year, freedom fighter Md., a resident of Narayanpara in Raninagar, Naogaon, Mofazzal Hossain also appealed to the Appellate Division for reconsideration of the verdict.
